1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Balanced Bite ("the App"), operated by NAG Solutions Limited ("we", "us", "our"). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 17 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

3. Account

• You are responsible for maintaining the security of your account and for all activity that occurs under it.
• You agree to provide accurate profile information.
• You may delete your account at any time from the Settings screen. Deletion is permanent and removes all your data.

4. Subscriptions & In-App Purchases

• The App offers optional Premium subscriptions on a monthly or annual basis.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the rate of your selected plan.
• You may manage your subscriptions and turn off auto-renewal in your device's Settings > Apple ID > Subscriptions after purchase.

5. Medical Disclaimer

Balanced Bite is NOT a medical device, and does NOT provide medical advice, diagnosis, or treatment.

The App provides educational meal planning tools and nutritional information. AI generated meal analysis is for informational and educational purposes only.

You must:

• Consult a healthcare provider before making any changes to your diet or diabetes management.
• Do not rely on the App as a substitute for professional medical advice.

We make no warranties about the accuracy, completeness, or suitability of any nutritional information or AI analysis provided through the App.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Interfere with or disrupt the App's servers or infrastructure
• Circumvent daily usage limits or rate limiting
• Create multiple accounts to avoid usage restrictions
• Scrape, harvest, or systematically extract data from the App
• Use the App to generate content for competing products

7. Nutritional Data and Recipes

Recipe and nutrition data is sourced from third-party providers (Spoonacular) and may contain inaccuracies. Always verify nutritional content with product packaging or your healthcare provider.

AI powered meal analysis (available to Premium subscribers) provides personalised educational commentary on meals using your profile and existing nutritional data. These insights are generated by artificial intelligence and are approximate in nature.

Shared meal data (recipe nutrition information) may be visible to other App users in an anonymised form.

8. Intellectual Property

The App, including its design, code, features, and content (excluding third-party recipe data), is owned by NAG Solutions Limited and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

9. Third-Party Services

The App integrates with third-party services including Supabase, Spoonacular, OpenAI, TelemetryDeck, Apple, and Google. Your use of these services is subject to their respective terms and privacy policies.

10. Push Notifications

The App may send push notifications to remind you to log meals, inform you of streak progress, or provide other relevant updates. You can manage or disable push notifications at any time in your device's Settings > Notifications > Balanced Bite.

11. Service Availability

• We strive to keep the App available but do not guarantee uninterrupted access.
• Features that depend on third-party APIs (recipe search, AI analysis) are subject to daily usage limits and third-party availability.
• We may modify, suspend, or discontinue features at any time with reasonable notice where possible.

12. Limitation of Liability

To the extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind, express or implied.
• NAG Solutions Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• We are not liable for any health outcomes resulting from dietary decisions made using information provided by the App.

13. Indemnification

You agree to indemnify and hold harmless NAG Solutions Limited from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

14. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may terminate your use at any time by deleting your account. Upon termination, your right to use the App ceases immediately and your data will be deleted in accordance with our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms in the App or by email. Continued use of the App after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the courts of England and Wales.
